CONGRESSMAN PETERSON: "STATUTE OF LIMITATIONS FOR MUSTERING-OUT PAY HAS EXPIRED"
WASHINGTON, DC Congressman Collin C. Peterson (DFL-7th District) has received official notification from the Office of the Assistant Secretary of Defense that the statute of limitations for collecting "Mustering-out pay", or separation pay, has expired.
"Several World War II and Korean War Veterans have contacted me after discovering their eligibility for this pay on their discharge papers. After researching this matter, I have found that the military can no longer process these requests," Peterson said. Veterans are remembering that they were issued a portion of the pay upon separation, but not the full amount. Unfortunately, the statute of limitations for payment of this kind has expired.
Title 31, United States Code, Section 3702 specifies that any claims of this nature must be made within six years after the claim accrues.
